No excessive use of force in Hamilton arrest that resulted in injury: SIU

The Special Investigations Unit (SIU) said they’ve found no reason to press charges against a Hamilton Police officer in relation to an arrest earlier this year where a suspect’s hand was broken.

The Special Investigations Unit (SIU) said they’ve found no reason to press charges against a Hamilton Police officer in relation to an arrest earlier this year where a suspect’s hand was broken.

The incident in question took place on May 1, 2019, when Hamilton Police was called to a residence at around 4 a.m. to reports of a disturbance.

When officers arrived on the scene, the SIU investigation report says, they were met by the 26-year-old suspect’s father who said his son was intoxicated and was making threats and was no longer welcome in the house.

Hamilton police reportedly placed the suspect under arrest at which time he complained of a hand injury but refused treatment.

A short time later, the suspect was released from police custody on the promise that he wouldn’t return to his father’s house, but a short time later, police were called back to the house when he did return.

He was arrested again and taken into custody when he complained again about his hand. This time, however, police did take him to St. Joe’s for treatment where it was discovered that his right hand had been fractured.

The SIU report says the suspect told the hospital staff that the arresting officers caused the injury.

After conducting an investigation into the incident, the SIU concluded, however, that there were no grounds to lay charges as “the evidence falls short of establishing on reasonable grounds that the [suspect’s] arrest was unlawful or that the force used in aid of the arrest was excessive.”

The report concludes that is was possible that the man sustained his injury during the earlier altercation with his father.
